Welcome to bodypreserve.com (the “Site”), operated by Body Preserve (“we,” “us,” “our,” or the “Company”), a medical spa located at 3200 Hayden Rd #275, Scottsdale, AZ 85251. These Terms of Service (“Terms”) govern your access to and use of the Site, including all content, features, products, and services offered through it.
By accessing, browsing, or using this Site — including making purchases, submitting contact forms, or interacting with any feature — you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms, policies, or guidelines referenced herein. If you do not agree to these Terms, you must discontinue use of the Site immediately.
We reserve the right to modify, update, or revise these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
1. Eligibility
You must be at least 18 years of age to use this Site, purchase products, schedule services, or otherwise interact with Body Preserve through the Site. By using this Site, you represent and warrant that you: (a) are at least 18 years old; (b) have the legal capacity to enter into a binding agreement; (c) are not barred from using the Site under any applicable law; and (d) will use the Site only for lawful purposes and in accordance with these Terms.
Certain medical spa treatments may have additional age requirements or medical eligibility criteria, which will be discussed during your in-person consultation with our licensed providers.
2. Description of Services
Body Preserve is a medical spa offering a range of aesthetic and wellness treatments performed by licensed, trained professionals. Our services include, but are not limited to:
Medical & Injectables: Botox, Dysport, dermal fillers (including hyaluronic acid-based fillers), hyper-diluted Radiesse, and Evolysse — administered by qualified injectors for cosmetic enhancement, wrinkle reduction, and facial contouring.
Laser & Energy Treatments: IPL PhotoFacial (intense pulsed light), CoolPeel CO2 laser resurfacing, Celluma LED therapy, radiofrequency (RF) microneedling, and XERF — for skin rejuvenation, pigmentation correction, collagen stimulation, and texture improvement.
Body Contouring: EMSCULPT NEO (muscle building and fat reduction), SculpSure (laser fat reduction), Exion Body (radiofrequency body treatments), and CryoSculpt (cryolipolysis) — non-invasive treatments for body shaping and toning.
Skin Care: HydraFacial (hydradermabrasion), Exion Microneedling with exosomes, and EmFace (facial muscle toning and skin tightening) — for complexion improvement, hydration, and anti-aging.
Hair Services: Laser hair removal and hair restoration treatments using Exion technology.
Women’s Health: EmFemme 360 — non-invasive feminine wellness treatments.
Retail Products: Medical-grade skincare products available for purchase through our WooCommerce-powered online store.
Service descriptions, pricing, treatment protocols, and availability on this Site are provided for general informational purposes only and are subject to change without notice. Specific treatment details, risks, benefits, contraindications, expected outcomes, and pricing will be discussed during your in-person consultation with our licensed providers prior to any treatment.

Individual Results May Vary: All aesthetic and medical spa treatments carry inherent risks and produce individual results. Before-and-after photographs, testimonials, and treatment descriptions displayed on this Site are for illustrative purposes only and do not guarantee, predict, or imply that you will achieve similar results. Your results will depend on your individual anatomy, health status, treatment compliance, and other factors that will be assessed during your consultation.
Informed Consent: All medical treatments performed at Body Preserve require informed consent. Prior to any procedure, you will receive a detailed explanation of the treatment, expected results, potential risks and side effects, alternative options, and post-treatment care instructions. You will be asked to sign an informed consent form before treatment begins.
Contraindications: Certain medical conditions, medications, allergies, or other factors may make you ineligible for specific treatments. Our providers will evaluate your medical history and current health status during your consultation to determine the appropriate treatment plan for you.
Not Emergency Services: Body Preserve does not provide emergency medical services. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. If you experience an adverse reaction following a treatment, contact our office immediately at (480) 788-2425 during business hours, or seek emergency medical attention if symptoms are severe.
4. Contact Forms, Communications, and Health Information
Our Site provides contact forms for general inquiries, appointment requests, and consultation scheduling. These digital communication channels are provided for convenience and are not designed, intended, or equipped for the submission of protected health information (“PHI”) as defined by the Health Insurance Portability and Accountability Act (“HIPAA”).
Do Not Submit: Please do not include detailed medical histories, diagnoses, current medications, prescription information, treatment records, insurance information, Social Security numbers, or any other sensitive health or financial data in any website form submission, email, or live chat communication.
Not HIPAA-Compliant: Communications submitted through our website contact forms, email (info@bodypreserve.com), and other digital channels are not encrypted to clinical standards and should not be considered a secure method of transmitting sensitive health information. We cannot guarantee the confidentiality of information transmitted through these channels.
If You Inadvertently Submit PHI: If you submit sensitive health information through our website despite this notice, we will delete it promptly upon discovery and will not use it for any purpose. However, we cannot be held liable for information you voluntarily submit through channels clearly marked as not intended for such data.
Clinical information, medical histories, and treatment-related communications should only be shared during in-person consultations, through our secure patient portal (if available), or through other secure channels specifically designated by our office.
5. Online Store, Purchases, and Payment
5.1 Product Orders
Products available through our WooCommerce-powered online store are subject to availability. We reserve the right to limit quantities, refuse or cancel orders, and discontinue products at any time without notice. All prices are listed in U.S. dollars and are subject to change without prior notice. Prices do not include applicable sales tax or shipping fees, which will be calculated and displayed at checkout.
By placing an order, you represent that: (a) all information you provide during the purchase process is accurate, current, and complete; (b) you are authorized to use the payment method provided; and (c) you agree to pay all charges incurred by you or on your behalf through the Site, including applicable taxes and shipping fees.
5.2 Payment Processing
Payment is processed securely through PCI DSS-compliant third-party payment processors. We do not receive, store, or have access to your full credit card number, CVV/security code, or bank account information. We receive only transaction confirmation, the last four digits of your card (for reference), transaction amount, and billing address.
5.3 Patient Financing
Patient financing options may be available through Cherry Technologies Inc. Financing is subject to credit approval and is governed by the terms of Cherry’s separate agreement with you. Body Preserve is not a lender and does not make credit decisions. Cherry independently collects and evaluates your financial information under its own privacy policy and terms of service. We do not receive your credit report, Social Security number, or detailed financial information from Cherry. By applying for financing through Cherry on our Site, you agree to Cherry’s terms and acknowledge that their privacy policy governs the collection and use of your financial data.
5.4 Order Acceptance and Cancellation
Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to cancel or refuse any order for any reason, including but not limited to: product unavailability, pricing errors, suspected fraud, or failure to meet eligibility requirements. If we cancel your order after payment has been processed, we will issue a full refund to your original payment method.
5.5 Shipping and Delivery
Shipping times, methods, and costs vary by product and destination. Estimated delivery dates are provided for convenience and are not guaranteed. Risk of loss and title for items purchased through our online store pass to you upon delivery to the carrier. We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control.
5.6 Refund and Return Policy
Refund and return policies for retail products will be provided at the time of purchase and may vary by product type. Certain items (such as opened skincare products, personalized items, or items marked as final sale) may not be eligible for return. Service deposits, prepaid treatment packages, membership fees, and gift card purchases may be subject to separate refund policies as communicated at the time of transaction. All refund requests must be submitted to info@bodypreserve.com within the applicable return period. Approved refunds will be issued to the original payment method within 10–15 business days.
6. Appointment and Service Policies
Scheduling: Appointments may be scheduled through our website, by phone, or through our booking platform. Scheduling an appointment constitutes your agreement to these Terms and any treatment-specific policies communicated at the time of booking.
Cancellation and No-Show Policy: We require advance notice for cancellations and rescheduling. Specific cancellation timeframes and any applicable fees will be communicated at the time of booking. Repeated no-shows or late cancellations may result in a required deposit for future appointments or, in extreme cases, refusal of future bookings.
Consultation Requirement: Many of our treatments require an initial consultation prior to treatment. During the consultation, our providers will assess your suitability for the requested treatment, discuss alternatives, review risks and expectations, and develop a personalized treatment plan.
Treatment Packages and Memberships: Prepaid treatment packages and membership programs, if offered, are subject to their own specific terms and conditions, which will be provided at the time of purchase. Packages and memberships are non-transferable unless otherwise specified and may have expiration dates.
7. Privacy, Cookies, and Data Collection
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, disclose, and protect your personal information. By using the Site, you consent to the data practices described in the Privacy Policy.

Trademarks: The Body Preserve name, logo, taglines, and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of Body Preserve. You may not use these marks without our prior written permission. All other trademarks, registered trademarks, product names, and company names or logos mentioned on the Site are the property of their respective owners.
Limited License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use. This license does not include the right to: (a) reproduce, distribute, publicly display, or publicly perform any content; (b) modify or create derivative works based on the Site or its content; (c) use any data mining, robots, or similar data gathering or extraction methods; (d) download (other than page caching) any portion of the Site or its content except as expressly permitted; or (e) use the Site or its content for any commercial purpose without our express written consent.

If you submit reviews, testimonials, comments, photographs, feedback, or other content (“User Content”) through our Site or third-party platforms, you grant Body Preserve a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in any media, for any purpose, including marketing and promotional purposes.
You represent and warrant that: (a) you own or have the necessary rights to submit the User Content; (b) the User Content does not infringe any third party’s intellectual property, privacy, or other rights; (c) the User Content does not contain any false, misleading, defamatory, or unlawful material; and (d) you will not include any sensitive personal information, medical details, or PHI in publicly visible User Content.
We reserve the right to remove, edit, or refuse to publish any User Content at our sole discretion, without notice, for any reason. We are not responsible for User Content submitted by third parties and do not endorse any opinions expressed therein.
11. Third-Party Links, Services, and Integrations
This Site may contain links to third-party websites, applications, and services that are not operated or controlled by Body Preserve, including but not limited to social media platforms (Facebook, Instagram, TikTok, LinkedIn), review sites (Google Business, Yelp), scheduling platforms, payment processors, and patient financing providers (Cherry Technologies).

13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BODY PRESERVE, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, SUBCONTRACTORS, SUPPLIERS, AND AFFILIATES (COLLECTIVELY, THE “BODY PRESERVE PARTIES”) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
(A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SITE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OR RELATED TO THE SITE; (C) ANY CONTENT OBTAINED FROM OR THROUGH THE SITE; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) ANY PRODUCTS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SITE; (F) ANY ERRORS, MISTAKES, OR INACCURACIES IN SITE CONTENT; OR (G) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR ACCESS TO AND USE OF THE SITE — REGARDLESS OF THE THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF THE BODY PRESERVE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE BODY PRESERVE PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO BODY PRESERVE THROUGH THE SITE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY; OR (B) ONE HUNDRED DOLLARS ($100.00).
THIS LIMITATION OF LIABILITY APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW AND SHALL SURVIVE THE TERMINATION OF THESE TERMS. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Important: Nothing in these Terms shall limit or exclude liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be lawfully limited or excluded under applicable law. This limitation of liability applies solely to claims arising from your use of the Site and these Terms, and does not limit any rights or remedies you may have in connection with medical malpractice or professional liability claims relating to in-person treatments.
14. Indemnification
You agree to indemnify, defend, and hold harmless Body Preserve and its owners, officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, suppliers, and affiliates from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees and court costs) arising out of or related to:
(a) Your access to or use of the Site; (b) your violation of any provision of these Terms; (c) your violation of any third party’s rights, including intellectual property, privacy, or publicity rights; (d) any User Content you submit, post, or transmit through the Site; (e) your violation of any applicable law, regulation, or ordinance; (f) any misrepresentation made by you; or (g) any dispute between you and any third party arising from your use of the Site.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any such matter without our prior written consent. This indemnification obligation shall survive the termination of these Terms and your use of the Site.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms, and any disputes arising out of or relating to these Terms, your use of the Site, or any products or services obtained through the Site, shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
15.2 Informal Resolution
Before initiating any formal legal action, you agree to first contact us at info@bodypreserve.com and attempt to resolve the dispute informally for at least thirty (30) days. Most concerns can be resolved through open and honest communication, and we are committed to working with you in good faith to find a mutually acceptable resolution.
15.3 Jurisdiction and Venue
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to jurisdiction or venue, including on the grounds of forum non conveniens.
15.4 Class Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST BODY PRESERVE. If this class action waiver is found to be unenforceable, then the entirety of this dispute resolution section (other than the waiver) shall be deemed void.
15.5 Statute of Limitations
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to your use of the Site or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred. This limitation does not apply to claims that cannot be contractually limited under applicable law.
16. Termination
We may terminate or suspend your access to the Site, in whole or in part, at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to: violation of these Terms, fraudulent or illegal activity, conduct harmful to other users, or conduct that could expose Body Preserve to legal liability.
Upon termination: (a) your right to access and use the Site will immediately cease; (b) you must promptly cease all use of the Site; and (c) any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 8 (Intellectual Property), 12 (Disclaimer of Warranties), 13 (Limitation of Liability), 14 (Indemnification), 15 (Governing Law and Dispute Resolution), and 20 (General Provisions).
17. Force Majeure
Body Preserve shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, public health emergencies, fire, flood, earthquake, severe weather, war, terrorism, civil unrest, government actions or restrictions, labor disputes, supply chain disruptions, power outages, internet or telecommunications failures, cyberattacks, or any other event beyond our reasonable control. In such events, our obligations shall be suspended for the duration of the force majeure event.
